Sheriff's patrol deputies responded to Milligan's residence where he was contacted and interviewed. With the assistance of Sheriff's detectives, a search of Milligan's residence was conducted and the firearm was located and seized. Milligan was subsequently arrested for PC 245(a)(2)/Assault with a Deadly Weapon - Firearm, PC 422 / Terrorist Threats, and PC 417(b)/ Brandishing a Firearm. He was transported to County Jail where he was held in lieu of $50,000 bail.

Allegations were that while seven juveniles were playing in the vicinity of the suspect's residence, they moved a log. Milligan allegedly confronted the juveniles while angry, threatened to kill them, brandished a shotgun, and discharged the weapon in their direction.
