Assault w/ Deadly Weapon, Brandishing a Firearm, Terrorist Threats

Contact: Sergeant PerryPhone: (805) 781-4553Date and time of incident: Sunday, February 20, 2011 at 2:54 PMPlace of Occurrence: Residence in the 500 Block of Skyline Drive, Los OsosVictim Information: Seven Juveniles, Approximate ages 12-14 of Los Osos; Names WithheldSuspect Information: Dan Richard Milligan, 59 years old, of Los OsosOn Sunday, 02/20/11 at 2:54 PM, the Sheriff's Department received the report of seven juveniles claiming to have been shot at by a resident in the 500 block of Skyline Drive in Los Osos. Allegations were that while seven juveniles were playing in the vicinity of the suspect's residence, they moved a log. Milligan allegedly confronted the juveniles while angry, threatened to kill them, brandished a shotgun, and discharged the weapon in their direction. No juveniles were injured in the incident but fled the area and reported the altercation immediately to authorities.
Sheriff's patrol deputies responded to Milligan's residence where he was contacted and interviewed. With the assistance of Sheriff's detectives, a search of Milligan's residence was conducted and the firearm was located and seized. Milligan was subsequently arrested for PC 245(a)(2)/Assault with a Deadly Weapon - Firearm, PC 422 / Terrorist Threats, and PC 417(b)/ Brandishing a Firearm. He was transported to County Jail where he was held in lieu of $50,000 bail.
