When Deputies arrived, a male victim told them he had been walking by the house with his girlfriend when he noticed a sign affixed outside the house warning people not to leave dog excrement in the garbage container. When the man looked inside the container, the owner came out of the house and the two proceeded to get into a verbal argument.
The owner than retreated back inside the house, came out with a 12 gauge shotgun, and fired a single shot into the ground approximately 10 feet away from the man and woman. No one was hurt.
The suspect has been identified as 67-year-old Christopher Patrick Dierks of Los Osos. He's been arrested for assault with a deadly weapon and will be additionally charged with negligent discharge of a firearm and brandishing a firearm.
Dierks is currently in custody with bail set at $50,000.
